Update on Electronic Payroll Reporting Requirement, Labor Law 220-j
As a follow up to last month’s Compliance Corner, we have learned more about the roll-out of the new requirement for filing electronic certified payroll reports and share it here.
First, the requirement is being applied to contracts solicited on or after December 31, 2025.
Second, if your project is in NY City (“under the jurisdiction of the NY City Comptroller”), your payrolls are to be filed with the City of New York. Here is a link to the City page, https://nyc-oti.ecomply.us/. Information about the online database can be accessed here, https://www.nyc.gov/site/communityhiring/resources/online-database-for-certified-payroll.page.
The payrolls are to be filed with the NYC Office of Community Hiring. If you follow this, you will find FAQs that are likely to answer most of your questions about the new law. NY City is using the information to check compliance with Articles 8 and 9 of the Labor Law as well as workforce hire goals.
Third, on the FAQ page, there is a link to a training dashboard, https://help.b2gnowsupport.com/hc/en-us/articles/41795251865876-eComply-Training-Classes-for-Contractors, where you can register for live training where you can ask questions or watch a one hour pre-recorded training session.
Fourth, if your project is outside the jurisdiction of the NY City Comptroller, you will have to submit your payroll with NY State DOL, https://mpwr-public.labor.ny.gov/en/login. Check back frequently to the NY State page, https://dol.ny.gov/Electronic-Payroll, because it seems that updates are being issued as the State works through the kinks in the system. For instance, a contractor can now add the same PRC number for multiple projects. The training materials provide a telephone number (518) 457-5589 and email, ask.pwask@labor.ny.gov, where you can get help.
