Diversity matters and is an increasing focus of government where it will impose financial penalties for non-compliance. MWDBE programs should be simple to implement and enforce but they are not. A contractor needs to know the program and advocate for themselves with general contractors and the government. You need to know what is required in the pre-award stage, how to establish good faith efforts and performance stage, and what to do in the event a firm does not perform. The funding source determines whether City, State, or Federal regulations will apply. How the locality enforces those regulations is different depending on the funding sources, whether the work is public or private, or how strict those regulations are interpreted. This session will focus on updates to city, state, and federal regulations, explain why you should pay attention to the regulations, delve into past failures as lessons learned, and identify effective enforcement strategies to comply with the program requirements. Topics included in this session include:
• Update and provide guidance regarding current regulations
• Describe the differences between city, state and federal regulations and layers of regulations
• Establishing Good Faith Efforts
• Proving a Commercially Useful Function
• Strategies if your Utilization Plan changes
• Reporting to your prime contractor and disclosures/certifications
• The Importance of Documenting Compliance”
